VI      Public Forum: Persons wishing to speak must fill out a speaker card and return it to the Clerk.  Comments will be limited to three (3) minutes.  Note, however, that State law and administrative rules prevent the Town Council from taking any formal action on any item discussed at this time.  The Council may schedule such items as regular agenda items and act upon them in the future.

VII     Consent Agenda - This section is reserved for routine, non-controversial items requiring council action. These items are handled with a singular motion and without council discussion. Any councilman may request that an item be removed from consent agenda for discussion under New Business.

IX      Public Hearing
A.      Ordinance 2011-09 – Owner, Brent Williams; Applicant:  John Hanson:  8.37 acre site adjacent to and west of the Meridian Center (BRPH Building) and adjacent to and east of 84 Lumber adjacent to and south of the Pineda Causeway.  See attached map.  Request:  Comprehensive plan amendment to change Location the future land use from industrial to commercial; Rezoning to change the zoning designation from M-1 (industrial) to C-2 (general commercial) (Second and Final Reading)   

AN ORDINANCE OF THE TOWN OF PALM SHORES, BREVARD COUNTY, FLORIDA, FOR A SMALL SCALE PLAN AMENDMENT TO CHANGE THE FUTURE LAND USE MAP FROM INDUSTRICAL TO COMMERCIAL AND THE ZONING DESIGNATION FROM M-1 TO C-2 FOR AN 8.37 ACRE PARCEL OF LAND DESCRIBED AS PARCELS 7.02, 8, 523 AND 526  IN, SECTION 19, TOWNSHIP 26 SOUTH, RANGE 37 EAST AND PARCEL 265 IN SECTION 30, TOWNSHIP 26 SOUTH, RANGE 37 EAST; PROVIDING FOR REPEAL OF EXISTING ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR FILING WITH THE BREVARD COUNTY PROPERTY APPRAISER; PROVIDING FOR FILING WITH THE SECRETARY OF STATE; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE.

        B.      Ordinance 2011-06 – Amending Title XV, Chapter 157 Zoning Regulations (First Reading)
                This ordinance was recommended for approval at the July 6, 2011 P&Z Board Meeting.  

AN ORDINANCE OF THE TOWN OF PALM SHORES, BREVARD COUNTY, FLORIDA, AMENDING TITLE XV, CHAPTER 157 ZONING REGULATIONS, OF THE CODE OF ORDINANCES OF THE TOWN; BY INCLUDING A DEFINITION FOR ADULT CARE FACILITIES,ARCADE AND ELECTRONIC GAMING ESTABLISHMENT, CYBERCAFE, INTERNET CAFÉ AND INTERNET SWEEPSTAKES CAFÉ; AMENDING SECTION 157.270 (C-1 NEIGHBORHOOD COMMERCIAL DISTRICT AND INTENT), SECTION 157.285 (C-2 GENERAL COMMERCIAL DISTRICT AND INTENT), SECTION 157.300 (C-P COMMERCIAL PARKWAY DISTRICT AND INTENT); SECTION 157.315 (M-1 LIGHT INDUSTRIAL);  ADDING SECTION 157.505 TO THE SUPPLEMENTARY DISTRICT REGULATIONS TO BE TITLED “PROHIBITED USES EAST OF THE EASTERN RIGHT-OF-WAY LINE OF US HIGHWAY-1; PROVIDING FOR CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR AREA ENCOMPASSED; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR INCLUSION IN THE TOWN OF PALM SHORES CODE.
